![]() The suo motu case came to be registered by the Commission against WhatsApp LLC and Facebook, Inc. The order which directed the Director General to commence an investigation had essentially clubbed the information which was received by the Commission along with suo motu case of 2021. The petitioner had approached this Court assailing the order dated Octopassed by the Competition Commission of India (Commission) in exercise of powers conferred by Section 26 of the Competition Act, 2002 (the Act). While passing a direction to investigate under Section 26(1) of the Competition Act, 2002, the Commission is merely calling upon the Director General to assist it in evaluating whether an infraction of the Act has been made out, held the Bench of Justice Yashwant Varma while dismissing the instant petition preferred by the petitioner. New Delhi, September 30, 2022: While considering the petition of Facebook India against the CCI probe into issues which arose from the updated privacy policy and terms of service for WhatsApp users, the Delhi High Court has held that the extent of the user data that may be shared and utilised by the petitioner would clearly be an aspect which may be required to be examined by the Director General.
